                  SMALL TOWN STORAGE LEASE AGREEMENT

   

    This Storage Space Lease Agreement (The Lease) is made and entered in to on__________________________ (Effective Date) by and between Little Creek Properties LLC dba Small Town Storage 1361 Thomas Rd New Paris, OH 45347 (the Owner) and _________________________________________________________________ (the Tenant), _______________________________________________collectively known as the “Parties.” The Parties hereby agree to as follows:

Terms and Conditions

1. Term

The Owner hereby leases to Tenant the storage space # ______________, a ___________ unit located at 127 Railroad St. New Madison, OH 45346, (Premises) with the effective date of ___________________________ and will continue on a month to month basis.

2. Rent, Late Fee and NSF Fee

Tenant agrees to pay _______________as rent in advance of the 1st of each month’s due date to the Owner or his or her agent by mail at P.O. Box 25 New Madison, OH 45346, via the website, or in person to the respective address of 127 Railroad St, New Madison, OH 45346. A receipt will be issued for payment of rent paid, including the money amount, the unit number and the period for which the payment is for. A Late fee of $15.00 will apply if not received by the 5th of month, and will be charged weekly until it is paid. The owner will change the locks on the 5th day. A Tenant’s check returned to the Owner for Non-Sufficient Funds (NSF) will incur a $29.95 charge, paid to the Owner in cash and will then require any future rent payments to be made in cash or money order, at the Owner’s sole discretion.  

3. Security Deposit

The Tenant shall give the Owner a security deposit in the amount of $40.00 for each unit as security for the performance by Tenant of the terms of this Lease and for any damages caused by the Tenant, Tenant’s family, agents, and visitors to the Premises during the term of the Lease. Upon termination of Lease, the deposit will be returned, within 30 days of signed termination, as long as no damages have been done to said unit.

4. Termination

Either party may terminate the Lease by providing thirty (30) days written notice to the other party. Any such notice shall be directed to the party at the party’s address listed in the Lease.

5. Use of Premises

Tenant will use the Premises exclusively for the storage of Tenant’s possessions. A tenant may not store or dispose of any property outside of the Premises. Tenant shall not use the Premises for any illegal or otherwise prohibited activities.

6. Dangerous or Illegal Materials

Tenant shall not keep or have on or around the Premises any item of a dangerous, flammable, or explosive nature that might unreasonably increase the risk of fire or explosion on or around the Premises or that might be considered hazardous by any responsible insurance company. Tenant shall not keep or have around the Premises any illegal items, materials, or substances.

7. Security and Liability

Tenant’s possessions will occupy the premises entirely at the risk of the Tenant. Owner is not responsible for carrying any insurance covering Tenant’s possession. Tenant should, at his or her own expense, obtain insurance for any possessions stored at the Premises. If the Tenant decides against insurance for their property, the Tenant releases the Owner from any loss, damage, claim, or injury resulting from any casualty on the Premises. 8. Maintenance

Tenant will, at Tenant’s expense, keep and maintain the Premises in good, clean and sanitary condition during the term of this lease and any renewal thereafter. Tenant will promptly advise Owner if the Premises are in need of any maintenance or repairs.

9. Assignment and Sublease

Tenant shall not assign or sublease any interest in the Lease.

10. Governing Law

This Lease shall be governed by the laws of the State of Ohio, County of Darke, Village of New Madison.

11. Entire Agreement

This Lease contains the entire agreement of the parties, and there are no other promises or conditions in any other agreement whether oral or written concerning the subject matter of this Lease. This Lease supersedes any prior written or oral agreements between the parties.

12. Severability

If any provision of the lease will be held to be invalid or unenforceable for any reason, the remaining provisions will continue to be valid and enforceable. If a court finds that any provision of this Lease is invalid or unenforceable, but by limiting such provision it would become valid and enforceable, then such provision will be deemed to be written, construed and enforced as so limited.

13. Amendment

This Lease may be modified or amended in writing, if the writing is signed by the Owner and the Tenant.

14. Waiver of Contractual Rights

The failure of either party, the Owner, and the Tenant, to enforce any provision under this Lease shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of this Lease.

15. Lien

As provided in Section 5322.02 Of the Ohio Revised Code, Owner shall have a statutory lien for the payment of charges that are due and unpaid by the Tenant. Owner’s lien applies to any personal property stored under the terms of this Lease in the above mentioned storage space. After proper notice and demand for payment, as required by statute, Owner may sell the personal property by auction and may credit the net proceeds against any amounts due under this Lease.

IN WITNESS WHEREOF, this Lease has been executed and delivered in the manner prescribed by law as of the Effective Date first written above.
